Facts
On March 18, 2008, plaintiff Nicole Prochnow was driving southbound on Santiago Avenue towards Seventh Street in Long Beach. At the intersection, Prochnow collided with a vehicle operated by defendant Chase Kaesman, who was driving a vehicle owned by his mother's employer without permission. Prochnow sued Chase Kaesman, his mother, Diane Kaesman, and her employer, Advanced Medical Optics Inc., for negligence and vicarious liability.
Prochnow reached a settlement with Diane Kaesman and Advanced Medical Optics and dismissed them from the action on Nov. 2, 2009.
Contentions
PLAINTIFF'S CONTENTIONS:
Prochnow alleged that Chase Kaesman drove at an excessive speed and ran a red light, causing the collision.
DEFENDANT'S CONTENTIONS:
The defense contended that Prochnow brought about the collision.
Settlement Discussions
Prochnow initially demanded $250,000, but reduced the demand to $10,000 with monthly payments at a 7 percent interest rate on the unpaid balance.
Result
The parties settled.
