Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff alleged that he developed and perfected a certain jerky recipe and, thereafter, the Juju Jerky trademark. Plaintiff further alleged that defendant used plaintiff's trademark without consent, including, in part, using the trademark on labels, Internet advertisements, and packaging for the sale of jerky.
DEFENDANT'S CONTENTIONS:
Defendant denied the allegations of plaintiff's claim. Defendant argued that he was the rightful owner of the JuJu Jerky mark. Defendant contended that he and plaintiff were business partners until 2010 when defendant paid plaintiff certain cash proceeds and thereafter continued to operate the jerky business.
Result
The court entered a judgment pursuant to a stipulation of the parties. Pursuant to the judgment, plaintiff was the rightful owner of the Juju Jerky trademark and defendant agreed to permanently cease using the trademark. Defendant was also ordered to permanently cease using the domain, www.jujujerksystore.com.
