PLAINTIFF'S CONTENTIONS:
Plaintiff alleged that in August 2012, she requested and obtained copies of plaintiff's consumer credit report from the three leading credit reporting agencies. It alerted plaintiff to defendant's attempt to collect a debt plaintiff allegedly owed on Dec. 5, 2011. However, plaintiff denied the debt's existence. Plaintiff also denied ever authorizing defendant to pull plaintiff's credit report. Plaintiff alleged that defendant's conduct of unlawfully obtaining a copy of plaintiff's credit report violated state and federal laws.
Plaintiff asserted causes of action for violating the Federal Fair Credit Reporting Act and violating California's Consumer Credit Reporting Agencies Act.
DEFENDANT'S CONTENTIONS:
Defendant moved to dismiss plaintiff's complaint for failure to state a claim for relief.
Result
The court granted ARS's motion to dismiss, and dismissed Crehin's claim with leave to amend.
