Contentions

PLAINTIFFS' CONTENTIONS:
Plaintiffs filed this lawsuit on behalf of themselves and others similarly situated. Plaintiffs alleged that they worked for defendants between Aug. 10, 2011 and May 7, 2012 at defendants' location in Corning. Plaintiffs alleged that their immediate supervisor subjected them to verbal abuse because of their national origin. Plaintiffs alleged that the supervisor, Timothy Molarius, called them "[expletives] Mexicans" and made similar comments in daily group meetings. On one occasion, plaintiffs alleged that Molarius waved a firearm at plaintiff Arce. Plaintiffs also alleged that defendants did nothing to remedy Molarius's abuse despite their repeated complaints.

Plaintiffs sued defendants alleging violation of Title VII under 42 U.S.C. Section 2000e and violation of FEHA under California Government Code Section 12940(j).

DEFENDANTS' CONTENTIONS:
Defendants denied plaintiffs' allegations, and asserted various affirmative defenses.

Result

The parties reached a $202,500 settlement.
