On Aug. 18, 2010, at 10:30 p.m., plaintiffs Jesse and Yvonne Woods were involved in a collision with defendant Joseph Soto.

Contentions

PLAINTIFFS' CONTENTIONS:
Plaintiffs contended that Soto's vehicle rear-ended the vehicle the plaintiffs' were seated in. Plaintiffs claimed that when defendant rear-ended the vehicle, the collision pushed plaintiffs' vehicle into the intersection. Plaintiffs claimed defendant's airbag deployed.

DEFENDANT'S CONTENTIONS:
Defendant admitted liability but disputed plaintiffs' nature and extent of damages.

Settlement Discussions

Plaintiffs had served a CCP 998 for Jesse Woods in the amount of $11,000 and $7,100 for Yvonne Woods. Defendant offered $10,000 for Jesse Woods and $6,800 for Yvonne Woods.

Damages

Plaintiffs claimed that because of the residual pain, general damages are more than what the defense was offering.

Injuries

Plaintiffs claimed to have suffered neck and back injuries. They were treated at the emergency room and with a chiropractor. Plaintiffs claimed they continued to suffer some degree of residual pain.

Result

Plaintiffs' verdict for $27,726. Plaintiffs were awarded $15,910 for Jesse Woods and $11,816 for Yvonne Woods.

Other Information
