Plaintiff Eric Earl Samuels was operating a tractor-trailer when he was involved in a collision with defendant's train. Plaintiff contended defendant struck his tractor-trailer while he was executing a right turn through a railroad crossing.

Plaintiff alleged that defendant was negligent in the operation and control of its train.

DEFENDANT'S CONTENTIONS:
