Robert Tuomi sued Edward Stewart, in connection with a motor vehicle accident.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff alleged that defendant rear ended his vehicle as he slowed for traffic near Solana Beach exit as he drove along Interstate 5, in San Diego. He was injured as a result, and sued defendant, alleging negligence. Plaintiff contended that defendant was not paying attention when the incident occurred.
DEFENDANT'S CONTENTIONS:
Defendant disputed the plaintiff's alleged back injury.
Damages
Tuomi requested $19,000 in past medical expenses and $20,000 in past lost of earnings.
Injuries
Tuomi claimed he fractured his back and underwent physical therapy for about a year. He also received epidural shots in the process. However, Tuomi claimed he continued to experience discomfort in his back, making it difficult to stand or sit.
Result
The parties reached a $200,000 settlement.
