Raul Taganas filed a personal injury lawsuit against the United States.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff alleged that he was employed as an able-bodied seaman and crewmember of the SS Cape Jacob. Plaintiff further alleged that on Feb. 17, 2011, he was ordered to perform work that required him to descend and ascend numerous vertical rung ladders. Plaintiff contended that the conditions of the sea that day made performance of his work obviously hazardous. Plaintiff further contended that the harsh movements of the vessel caused him to injure his right shoulder while on a vertical ladder.

DEFENDANT'S CONTENTIONS:
Defendant denied the allegations of plaintiff's claims and asserted various affirmative defenses.

Result

The parties settled the case and stipulated to a consent judgment, under which defendant agreed to pay $50,000.
