PLAINTIFFS' CONTENTIONS:
Plaintiffs alleged that they worked as technicians for defendants, installing telecommunications equipment in cellular phone towers, and worked over forty hours per workweek. Plaintiffs further alleged that defendants failed to pay them, as well as similarly situated workers, the proper minimum wage and overtime rates as required by the Fair Labor Standards Act and the California Labor Code.
DEFENDANTS' CONTENTIONS:
Defendant denied the allegations of plaintiff's claims and asserted various affirmative defenses.
Result
Plaintiffs and United Commtel settled the case. The court then entered an order approving the settlement and dismissing the action. Pursuant to the settlement, United Commtel agreed to pay $175,000.
