Dale Ekstrom and Diane Ekstrom sued Rahelia Petian relating to a motor vehicle collision.
Contentions
PLAINTIFFS' CONTENTIONS:
Plaintiffs alleged that while in a Sam's Club parking lot, they saw defendant's car parked in a handicap spot without a disability placard. Plaintiffs further alleged that when Diane told defendant that she needed a disability placard in order to park in a handicap spot defendant began arguing with her. Plaintiffs contended that when they attempted to leave, defendant struck their car with her car and then struck Dale when he attempted to stop the defendant from fleeing the scene.
DEFENDANT'S CONTENTIONS:
Defendant argued that her car never touched the plaintiff's car. Defendant further argued that Dale Ekstrom threw himself on the ground in front of defendant's vehicle and then falsely accused her of hitting him.
Injuries
Dale Ekstrom alleged neck and back injuries and Diane Ekstrom alleged that she suffered a heart condition and emotional distress as a result of the incident.
Result
After a jury trial, the jury returned a verdict in favor of the defendant, finding that the defendant was not negligent.
