Juan Cuevas sued Sky West Airlines and Juan De La Cruz, in connection with an employment dispute.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff alleged that he worked for defendant Sky West as a ramp agent at the San Francisco International Airport from 2006 until 2011. He alleged that De La Cruz was in charge of Sky West's customer service and ramp operations. Plaintiff alleged that he was fired for complaining about safety issues. Plaintiff asserted claims for violation of the federal and state whistleblower protection laws, wrongful termination in violation of public policy, breach of implied covenant of good faith and fair dealing, breach of implied and/or express contract of continued employment and negligent supervision.
DEFENDANTS' CONTENTIONS:
Defendants alleged that plaintiff was fired for insubordination. Defendants denied plaintiff's allegations and asserted various affirmative defenses. Defendants also moved for summary judgment.
Result
The district court granted defendants' summary judgment motion as a whole.
