Samuel Meguerditchian and Mariam Meguerditchian sued All Yellow Taxi Inc. and Manuel Iskandaryan.

Contentions

PLAINTIFFS' CONTENTIONS:
Plaintiffs alleged that Samuel was walking in a parking garage when Iskandaryan negligently drove his vehicle in reverse and ran into Samuel, knocking him to the ground. Plaintiffs further alleged that Samuel was 89 years old at the time of the incident and as a result of such incident Samuel sustained injuries requiring constant attendant care.

DEFENDANT'S CONTENTIONS:
Iskandaryan argued that Samuel's injuries were exaggerated and that plaintiffs were seeking damages for conditions that pre-existed the accident. Iskandaryan contended that Samuel was receiving 24-hour care years before the accident for similar issues that were being claimed in plaintiffs' suit. Iskandaryan also argued that since Samuel's medical records showed similar pre-accident conditions that plaintiffs denied he had, Samuel was committing fraud in order to receive government benefits.

Damages

Plaintiffs alleged damages in the range of $450,000 to $550,000.

Injuries

Plaintiffs alleged that Samuel suffered a concussion and traumatic brain injury.

Result

The claims were dismissed against All Yellow Taxi before trial. After a jury trial on the issue of damages, the jury awarded Samuel $30,000 against Iskandaryan.
