On July 25, 1994, at 2:45 p.m., plaintiff Theresa Aubuchon, a 25-year-old waitress, was the right rear seat passenger in defendant Kimberli Jack's vehicle, traveling in the No. 2 eastbound lane approaching an intersection. The driver of another vehicle, with whom the plaintiff settled before trial, turned left from Mason street attempting to cross Perkins and enter a grocery store parking lot, but collided with the defendant driver's vehicle. The plaintiff brought this action against the defendants, the driver and owner of the vehicle, based on a negligence theory of recovery.
