Facts
On Aug. 29, 1996, defendant Jackie Matthews injured her right ankle in an automobile accident. Since the driver of the other vehicle was not insured, the defendant submitted a claim to the plaintiff, Country Mutual Insurance Company, which provided uninsured motorist coverage to defendant. The parties allegedly verbally settled the defendant's underlying uninsured motorist claim for $30,000. The defendant then changed her mind and informed the plaintiff that she would retain a lawyer because the settlement amount was too low. Plaintiff Country Mutual then brought a declaratory relief action to enforce the verbal agreement.
