Facts
On Dec. 28, 1994, plaintiff Jenny Oliver, age 19, was driving her vehicle northbound on Interstate-25. Due to ongoing construction, traffic was limited to the right lane of the highway. Traffic came to an abrupt halt when the plaintiff's vehicle was rear-ended by a vehicle driven by defendant Grant Gieringer. The plaintiff brought this action against the defendant based on a negligence theory of recovery.
