In June 1995, the plaintiff, a 20-year-old sales representative, became acquainted with the defendant. Shortly thereafter, the two began a dating relationship. In November 1995, the defendant allegedly began harassing and intimidating the plaintiff. Due to defendant's conduct, the plaintiff broke off the relationship and moved her residence from Portland, Ore. to Burbank, Calif. The plaintiff alleged that in December 1995, the defendant began threatening to write a book purporting to detail the sexual history and habits of the plaintiff. In February 1996, the plaintiff and the defendant resumed hospitable relations by telephone. In March 1996, the defendant traveled from his home in Portland to the plaintiff's residence in Burbank. During this visit, the defendant reportedly became angry and paranoid due to his unwarranted suspicions that the plaintiff had become involved with other men. On March 21, the plaintiff spoke with the defendant by telephone and the plaintiff alleged the defendant made threats directed towards her and her family. The plaintiffs brought this action against the defendant based on a negligence infliction of emotional distress theory of recovery.

The plaintiffs made a settlement demand for $99,000. The defendant made no offer.

The plaintiffs claimed they suffered fear, embarassment, humiliation, severe mental pain and suffering and emotional distress.
