Pastor Alba had just enjoyed a nice meal at a Sizzler restaurant, and was exiting the building when he fell. He filed suit against the restaurant.

Contentions

PLAINTIFF'S CONTENTIONS:
The plaintiff claimed that the exit door closed too quickly and strongly, causing it to slam shut and causing him to fall.

DEFENDANT'S CONTENTIONS:
The defendant claimed plaintiff's own negligence had caused his fall.

Settlement Discussions

The plaintiff demanded $35,000. The defendant offered $2,500.

Injuries

The plaintiff sustained fractured ribs as a result of his fall. He also claimed emotional distress.

Result

The jury found for the defense. The defendant was awarded $1,866 in costs.
