Facts

The Public Interest Law Project of Oakland and the Bay Area Legal Aid filed a lawsuit on behalf of Greg Versis, Alfredo Garcia, and Lee Lee against the County of Marin, accusing it of using illegal and unfair methods to refuse subsistence aid to the poor.

Result

The county agreed to settle the matter by making significant changes that will increase the ability of desperately needy people to obtain subsistence benefits. Under the settlement, application interviews will be scheduled within seven business days and eligibility will no longer be conditioned upon completion of certain programs. However, general assistance recipients may still be required to meet certain conditions to continue receiving general assistance. Fair hearings to contest denials or terminations of aid will comport with due process and in accordance with C.C.P. §1094.5. In addition, the court retained jurisdiction for three years to enforce the settlement provisions.
