Facts
Paramount Pictures Corp. and Melange Pictures LLC sued International Media Films Inc. over ownership of the motion picture, La Dolce Vita. The complaint sought declaratory relief as to Defendant's alleged lack of ownership of copyright in the film, and declaratory relief as to exclusive ownership of United States copyright in the film. Plaintiffs filed a motion for summary judgment.
Result
The court granted plaintiffs' motion in part, and denied it in part. Partial summary judgment was granted in plaintiffs' favor with respect to their first claim of relief because International Media does not own, and at no time has owned, the U.S. copyright in the film. Partial summary judgment was also granted in plaintiffs' favor with respect to their second claim for relief because plaintiffs have exclusively owned, at all relevant times, the U.S. copyright to the film. Summary judgment was also granted in plaintiffs' favor with respect to their contributory infringement claim against International Media.
