Facts
Crescencio Galvez, Carmen Acuna and Guadalupe Galvez filed a consumer class action against Touch-Tel U.S.A. LP dba Touch-Tel USA LLC in connection with pre-paid telephone cards offered by defendant. The complaint alleged that the company violated state statutory laws prohibiting unfair and deceptive business practices by misrepresenting the number of minutes of international and long distance telephone service the cards provide and/or concealing various fees charged to consumers that further reduced the number of minutes available. Plaintiffs also alleged breach of contract.
Result
Without admitting liability, Touch-Tel agreed to settle the matter by providing a refund in $2.00 increments to eligible claims, not to exceed $20.00 per claim. Tel-Touch set the total cap for all refunds at $375,000.
