Facts

The U.S. Equal Employment Opportunity Commission (EEOC) filed a complaint against Genesco Inc. dba Journeys, a teen apparel store, alleging pregnancy discrimination. Leah Marshall was an assistant manager at a Journeys store in Newark. Because of her pregnancy, she necessitated a leave of absence, but when she sought to return six weeks later, she was told that her job no longer existed. The complaint also alleged that the store had a job opening at the time after having dismissed another assistant manager just before the holiday shopping season. The company claimed it was downsizing and denied any wrongdoing.

Result

Journeys agreed to settle the pregnancy discrimination lawsuit for $25,000, which included $5,000 for Marshall's lost wages and $20,000 for emotional distress. The company also agreed to train its managers in preventing pregnancy discrimination.
