Facts

Tanisha Gonzalez sued KSC, alleging breach of contract. She satisfied her obligations under the Government Claims Act by presenting her government claim against KSC as required. KSC then demurred to the operative pleading because Gonzalez failed to timely initiate her lawsuit within six months of the rejection of her government claim as statutorily required.

Result

Because of the delay, Gonzalez's claims were barred, and KSC was able to successfully demur to the operative pleading. The matter was thereafter dismissed with prejudice.
