Facts

Plaintiff Roxsanna Robertson used to work for Ralphs Grocery Co. and Food 4 Less of California Inc. She filed an action for penalties under the California Labor Code Private Attorneys General Act (PAGA), seeking compensation based on allegations that Ralphs and Food 4 Less failed to provide employees meal and rest breaks, failed to pay employees all wages due, and failed to reimburse them for expenses necessarily incurred in performing their work.

Result

The court sustained defendants' demurrer to the plaintiff's complaint, determining that plaintiff had failed to exhaust her administrative remedies under PAGA before filing the complaint.
