Facts

Plaintiffs Patrick and Julie Missud filed a class action against Oakland Coliseum Joint Venture (OCJV), alleging violations of the Clean Water Act, violations of the Resource Conservation and Reclamation Act, violations of the Americans with Disabilities Act, and other causes of action.

Plaintiffs argued that the Coliseum had hosted a concert featuring the band U2, and that OCJV had cut services to maximize the profits of that concert. These services included providing access to the venue, security, safe premises, sanitary facilities, light, ventilation, water, safety evacuation plans, ramps, walks, elevators, on-site emergency services, and parking. The Missuds attended the concert, but found the facilities were severely deficient or non-existent.

Result

The court granted the defendants' motion to dismiss.
