Cornucopia Products LLC v. Dyson Inc., Dyson Technology Limited

Published: Jul. 13, 2013 | Result Date: Jul. 27, 2012 | Filing Date: Jan. 1, 1900 |

Case number: 2:12-cv-234 Bench Decision –  Preliminary Injunction Granted

Facts

Plaintiff Cornucopia Products LLC filed suit against Dyson Ltd., accusing them of violating the Sherman Act by illegally monopolizing the bladeless fan market through fraudulent patents.

Dyson Technology Limited filed a separate suit against Cornucopia, seeking to enjoin the sale of Cornucopia's bladeless fan. Dyson alleged that the fan was "almost a direct copy" of Dyson's bladeless fan. Although there were a few differences, the overall appearance was strikingly similar. It was undisputed that the design had been intentionally copied.

The two matters were consolidated.

Result

The court granted a preliminary injunction for Dyson.
