Facts

Center For Biological Diversity and Center For Environmental Health filed a complaint against the acting Administrator of the United States Environmental Protection Agency (EPA), alleging that the EPA failed to undertake certain nondiscretionary duties under the Clean Air Act that were actionable under the Act in connection with the EPA's alleged failure to take action in finding failures to submit infrastructure state implementation plans (SIPs) for several states with regard to the 2008 lead National Ambient Air Quality Standard.

Result

The parties entered into a consent decree whereby the EPA was required to take specified actions within the time allocated.
