Facts

Veronica Bowers and Native Songbird Care and Conservation filed suit to stop work on the Highway 101 widening project at the Petaluma River Bridge. They alleged that construction of the bridge was disturbing and killing cliff swallows, a federally-protected bird species. The bridge work was part of a $130 million Caltrans project to alleviate traffic congestion on Highway 101 through Petaluma.

Result

The court denied plaintiff's request and cleared the way for continuing work on the project.
