On Dec. 26, 2010, Brooks and Monica Iler suffered a kitchen fire at their San Diego home. They filed a claim with their insurance carrier, Hartford Underwriters Insurance Co., for repairs and cleaning. Hartford paid the claim in the amount of $171,030.
The Ilers and Hartford both filed a complaint against General Electric Co., claiming that the fire originated from a GE wall oven. They alleged that GE defectively manufactured the oven, causing the fire. The Ilers later resolved their claims against GE confidentially, and Hartford proceeded to trial with its subrogation claim.
