Beverly Graves was walking in the hallway of Willowbrook Senior Center in East Los Angeles. While turning a corner, she tripped and fell over the pronged leg of a sign. She sued Willowbrook, which was owned by the County of Los Angeles. She argued that the center was negligent in the placement of the sign, creating a dangerous condition. The sign's four pronged legs extended out beyond the width of the sign, allegedly creating a hazardous condition. The sign was also negligently placed at the corner of the hallway, where it was not visible to Graves as she turned.
Willowbrook argued that there was no dangerous condition and that the sign had been used for several years. The legs were noticeable and safe.
Damages
Graves claimed $59,116 in past medical costs and $475,000 in general damages.
Injuries
Graves sustained a fracture to her right femur. She underwent open reduction and internal fixation with the insertion of a rod. She was hospitalized for roughly four days and then transferred to a convalescent facility, where she remained for two months. She claimed to still experience residual pain.
Result
The jury found Willowbrook 70 percent at fault. Graves' total damage award of $159,116 was reduced to $111,381.
