Facts

Martimiano Miguel was driving on Olympic Boulevard with his wife in the passenger seat. When they stopped due to traffic, they were rear-ended by a vehicle operated by Chan Nam. The collision pushed their vehicle into the vehicle in front of them.

The Miguels sued Nam, alleging motor vehicle negligence. They claimed that Nam was distracted by people moving out of a house to his left and failed to slow down.

Nam did not contest liability.

The Miguels both claimed soft-tissue injuries to their neck and back. They were treated with six weeks of chiropractic care. A year later, when pain persisted, they were diagnosed with chronic pain syndrome.

Result

The jury awarded the Miguels $15,175.
