Facts

The International Church of Four Square Gospel filed suit against the City of San Leandro after the City denied the Faith Fellowship Church's application to relocate its church campus to the city's high-tech industrial core. The City stated that this move would violate its zoning code, and that the church had knowingly deleted the escrow escape clause requiring land use entitlements be obtained before escrow closes.

The lawsuit alleged that the denial of the application violated the Religious Land Use and International Persons Act, the Civil Rights Act, and the First Amendment.

Damages

The church sought $20,000,000 in damages for lost contributions, carrying costs, as well as loss on sale of property and expenses related to the purchase and sale, plus attorney's fees.

Result

The parties settled for $2.3 million.
