Auxogyn, Inc. is a developer of innovative technologies aimed at improving the success rate of in vitro fertilization treatments. Unisense Fertilitech A/S filed a suit against Auxogyn, seeking declaratory relief of non-infringement, invalidity, and unenforceability of Auxogyn's patent.

Result

The Court dismissed Unisense's complaint with leave to file an amended complaint consistent with its order, finding Unisense had no reasonable apprehension of a patent infringement lawsuit.
