Facts

Diamond jewelry company, Eyal R.D. Corp., filed a federal copyright claim against Jewelex New York Ltd. related to Eyal's copyrighted Prinuette ring design using alternating princess-cut and baguette-cut diamonds in a channel setting. Jewelex claimed that the ring was not subject to copyright because its registration was invalid. It also claimed that its ring was independently created in India.

Result

The parties entered into a consent decree just days prior to trial. Jewelex agreed not to contest that Eyal was the owner of a valid copyright and it agreed to stop selling rings with the princess/baguette-cut.
