Facts

The accident occurred on Feb. 9, 2002 at the intersection of Olympic and Broadway in Los Angeles. The defendant was eastbound on Olympic. The plaintiffs were northbound on Broadway. Both parties claim they had a green light. The plaintiffs' vehicle collided with the passenger's side rear of defendant's vehicle. A witness for plaintiffs testified that the defendant ran the red light.

Contentions

PLAINTIFFS' CONTENTIONS:
The plaintiffs contended that the defendant was negligent in running the red light. The plaintiffs' witness supported plaintiffs' version of the facts.

DEFENDANT'S CONTENTIONS:
The defendant contended that the plaintiffs ran the red light. The defendant entered on a green light. The defendant also contended that the plaintiffs never saw the defendant before the accident and ran their vehicle into the passenger side rear of the defendant's car.

Settlement Discussions

The defendant offered a waiver of costs by C.C.P. section 998.

Injuries

The plaintiff driver, Paik Nikbakht, claimed soft tissue injuries and chiropractic care. The plaintiff passenger, Arian Nikbakht, a minor, claimed soft tissue injuries.
