Facts
In June 2004, plaintiff Phyllis Majlessi was riding one of defendant Los Angeles County Metropolitan Transportation Authority buses. According to plaintiff, the bus was extremely crowded, and she was forced to exit at a stop to allow a passenger carrying a golf bag to exit. When the plaintiff tried to re-board the bus, she reached for the handrail and the driver shut the door on her arm. The plaintiff asserted that the driver was distracted, as he was talking to people inside the bus when he closed the door. The plaintiff alerted the driver that her arm was caught in the door. The driver opened the door and apologized.
