Facts

After doing drugs and drinking alcohol all night, Ian Collis, a minor, went to Johnny Quik #111, a liquor store, where he purchased and drank several beers. The liquor store was owned by Karindaljit Kahlon, Birkamjit Kahlon and Narander Kahlon. Thereafter, Collis went to a health club where he was turned away due to the fact that he was intoxicated. A half an hour after Collis left the liquor store, he was involved in an automobile accident with Don Loomer. Loomer, 42, had entered an intersection in Fresno on a green light when Collis, who was still intoxicated, collided with the driver's side of his vehicle. Collis had entered the intersection on a red light. Loomer's vehicle was totaled. Loomer, who was a radiologist, slipped into a coma.

The plaintiff contended that the liquor store should not have sold alcohol to the defendant who displayed signs of intoxication.

Damages

The plaintiff's wife made a claim for loss of consortium.

Injuries

The plaintiff fell into a coma after the accident. He also suffered serious injuries consisting of a hematoma to his head and neck, a hemorrhage in his head, fractures to his scapula, pelvis and ribs, a contusion to his left lung, injuries to his shoulders and hip, and an aortic tear. The plaintiff requires a feeding tube because he has trouble swallowing. In addition, he suffers from headaches, scars and emotional distress.

Result

The plaintiff and the liquor store settled for $1,000,000.

Other Information

The case against Collis has yet to reach trial.
