Facts
Sixty-four-year-old decedent was struck and killed by a truck owned and operated by defendant, Roe Company, while crossing the street in a marked crosswalk . The truck was driven by a Roe employee while in the course and scope of his employment. The plaintiffs included the decedent's 70-year-old husband, and her three adult children. There was no claim for special damages as the decedent was retired at the time due to the sale of the family restaurant.
Result
The parties stipulated to liability during the course of litigation and intended to try the case on damages only. Ultimately, the case was resolved for $2 million pursuant to a C.C.P. Section 998 offer from defendant prior to trial.
