Facts
According to plaintiff Richard Schneider, an attorney, while riding his motorcycle, he crashed into a center median island that was unmarked and placed in the middle of a two way center turn lane, resulting in severe brain injuries.
Contentions
PLAINTIFF'S CONTENTIONS:
The plaintiff claimed that defendant city of Santa Monica did not adhere to its signage and striping plan when it failed to place warning signs at the south side of the median island and failed to use appropriate striping to mark the road as a two-way center turn lane. As a result, Schneider entered the center lane without any warning of the upcoming obstacle.
DEFENDANT'S CONTENTIONS:
The city contended that plaintiff hit the median island when he attempted to pass a SUV in front of him. It further alleged that installation of warning signs on the south side of the median island was within its discretion, and it concluded warning signs on the island were not necessary.
Injuries
According to the plaintiff, Schneider suffered severe permanent brain injury, inhibiting his cognitive functions. He is unable to walk without help and cannot interact as he did prior to the incident.
Result
A structured settlement was agreed to in the amount of $4,400,000 (present value).
Other Information
AIG was the insurance carrier involved in the settlement for the city of Santa Monica.
