Facts

On Jan. 30, 2002, plaintiff Paul Gomez was struck by a vehicle driven by defendant Kate Hak In while standing in the pick-up line of a parking lot owned by defendant Westminster Academy Christian Day School. He sued defendant In for motor vehicle negligence and defendant Westminster for negligent supervision.

Contentions

PLAINTIFF'S CONTENTIONS:
The plaintiff contended defendant In negligently drove her vehicle and defendant Westminster negligently encouraged plaintiff and other students to wait, walk, stand, assemble, pool, and loiter in the parking lot, which defendant should have known was unreasonably dangerous.

Injuries

The plaintiff sustained distal right femoral diaphysis and bowing of the right knee joint.

Result

The parties agreed to a $75,000 settlement against defendant, including $4,330 in medical expenses, $18,750 in attorney fees, and $1,817 in expenses.
