Facts
Plaintiffs Stephanie Reed was walking with her boyfriend, Jermaine Dixon, in front of defendant Felix Dominguez's house when Dominguez's dogs startled her. As a result, the plaintiff chose to run into the street and was struck by defendant Willie Woods' car, which was driven by defendant Venicia Starr Florio.
Contentions
PLAINTIFFS' CONTENTIONS:
Plaintiff Reed alleged the dogs came out of the gate and claimed emotional distress. Plaintiff Dixon alleged the gate was slightly open and the dogs were trying to get out.
DEFENDANT'S CONTENTIONS:
Defendant Dominguez contended the dogs were fenced inside his property at all times and that plaintiff Reed's reaction was unreasonable.
Defendants Florio and Woods cross-claimed against plaintiffs and defendant Dominguez.
Result
The case settled for $100,000, defendant Dominguez's Allstate Insurance Company's policy limit ($95,000 awarded to Reed and $5,000 to Dixon).
