Alice Lovell sued Cynthia Abbate, in connection with a motor vehicle accident.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff contended that she was crossing the street on a crosswalk when a vehicle driven by defendant struck her. Plaintiff fell to the ground, and the car then ran over her foot. Plaintiff suffered injuries as a result and sued defendant, alleging negligence.

DEFENDANT'S CONTENTIONS:
Defendant partially blamed plaintiff for the accident.

Damages

Lovell requested an unspecified amount in damages for her medical expenses and pain and suffering.

Injuries

Lovell claimed she sustained injuries to her lower back and shoulder, limiting her shoulder rotation. She underwent surgery to her shoulder and treated with a chiropractor.

Result

The parties reached a $35,000 settlement.
