The plaintiff was photographing trucks parked in defendant's yard, as part of a long standing dispute over defendants legal right to park vehicles in his yard. The plaintiff contended that the defendant grabbed the film and camera from his hand, thereby twisting and re-injuring a prior rotator cuff tear in his right shoulder.
