Tyco Healthcare Group LP, doing business as VNUS Medical Technologies Inc., filed an action against Total Vein Solutions Inc. LLC and Biolitec AG for patent infringement.
Total Vein Solutions promoted products relating to nonsurgical procedures for eradicating varicose veins. These products included venous surgery procedure packs, laser fibers, access devices, surgical supplies, and compression hosiery. Biolitec was in the business of selling surgical and cosmetic lasers, and disposable medical materials for urological and skin care purposes.

PLAINTIFF'S CONTENTIONS:
Plaintiff alleged that defendants infringed on its patents for eradication of varicose veins using lasers. Specifically, plaintiff claimed that defendant infringed on its endovenous laser ablation process.
Result
Plaintiff was awarded $45.84 million, which included $36.5 million against Total Vein and $9.34 million against Biolitec.
