Facts

Illumina Inc. brought suit against its rival genetic testing instrument maker, Affymetrix Inc., alleging patent infringement. San Diego-based Illumina alleged that Affymetrix's scanner products and array plates, used to analyze multiple gene samples, infringed on its patents.

Affymetrix moved for summary judgment and sought dismissal of the suits.

Result

The court granted Affymetrix's motion for summary judgment and dismissed the suits filed by Illumina. The court determined that Affymetrix did not infringe on patents held by Illumina.
