Harold Black was reassigned from his position as a sales and service distribution associate at the Petaluma U.S. Post Office after he failed a required qualifying test on July 22, 2005. He was subsequently reassigned as a rural carrier.

Contentions

PLAINTIFF'S CONTENTIONS:
Black filed suit against the Postmaster General, alleging discrimination based on race, sex, and national origin. He contended that female employees and those of other national origins were not reassigned after failing the same test.

DEFENDANT'S CONTENTIONS:
The defense denied the allegations.

Result

The jury found Black engaged in a protected activity, but had not suffered an adverse employment action.
