Facts

U.S. Secretary of Labor, Hilda L. Solis, filed an action for violations of minimum wage and overtime provisions of the Fair Labor Standards Act 29 U.S.C.201 et seq. The U.S. Department of Labor, San Francisco Regional Office of the Office of the Solicitor, filed lawsuit on behalf of the Secretary against defendants Laundry Room and its owner, Milton Kaneda.

The suit was filed on behalf of 115 current and former workers of Laundry Room Clothing, Inc., relating to alleged violations, occurring between Feb. 7, 2009 and March 31, 2010.

Contentions

PLAINTIFFS' CONTENTIONS:
Plaintiffs alleged that defendants violated California labor laws by failing to pay minimum wage and overtime. Plaintiffs claimed that defendant violated the Fair Labor Standard Act by failing to pay the federal minimum wage, which included $7.25 per hour in addition to extra earnings for time worked over 40 hours.

Result

The court awarded plaintiffs $887,000.
