Facts
On Oct. 14, 2011, Gregg Guenthard was driving when Emily Schwartz broadsided him. Guenthard sued Schwartz, claiming she was negligent in the operation of her vehicle. He claimed he was traveling straight while Schwartz was controlled by a stop sign. As a result, Schwartz did not yield to oncoming traffic and caused the collision.
Schwartz admitted liability.
Damages
Guenthard sought $280,000 in past medical costs.
Injuries
Guenthard sustained a fracture to his left arm, a tear of the left rotator cuff and a sprained right knee. He also complained multiple contusions and a laceration to his right eye. He underwent surgery on his left arm and required several months of physical therapy. He also suffered a facial fracture above his left eyebrow and the entire left side of his face. The injury to the right eye was "ocular whiplash," confirmed by a defense examination, according to plaintiff. Swelling occurred in the eye stem, which permanently injured the nerves in his right eye. He experienced 60 percent vision loss. Nothing could be done to fix his right eye.
Result
The parties settled for $609,000.
