On May 11, 2010, Yanina Chechelnitskaya was driving her sports utility in Studio City when she was rear-ended by a pickup truck operated by Athens Bordokas during stop-and-go traffic. Chechelnitskaya suffered injuries as a result thereof and sued Bordokas.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff contended defendant was negligent in the operation of his vehicle.

DEFENDANT'S CONTENTIONS:
Bordokas admitted liability for the accident, and the matter proceeded to causation and damages.

Damages

Chechelnitskaya's SUV was damaged. Bordokas incurred roughly $600 in damages to his front bumper. Chechelnitskaya claimed $5,700 in past medical costs and sought $2,000 to $3,000 in future medical costs. She also sought $50,000 in pain and suffering. Bordokas claimed Chechelnitskaya overtreated, and should not be awarded damages. On the alternative, he argued $3,500 for reasonable medical bills and pain and suffering.

Injuries

Chechelnitskaya claimed injuries to her neck and back. She presented to a chiropractor the next day and was diagnosed with strains and sprains. She underwent a course of chiropractic care, with a total of 32 visits. She continued to experience occasional flare-ups, which she claimed would require further treatment. Bordokas' expert disputed the extent of Chechelnitskaya's injuries, claiming they were very minor and required only minimal treatment.

Result

The jury determined Chechelnitskaya incurred $8,000 in total damages, which included $5,620 for past medical cost and $2,380 in past pain and suffering.
