Pamela Gibson filed suit against the McDonnell Douglas Corp. and the Boeing Co. Gibson was the daughter of Patricia Gibson, who died in 2010 of breast and bladder cancer while employed at Long Beach City College Auxiliary Inc.
McDonnell and Boeing designed, manufactured, and built aircraft parts at various locations throughout Southern California, including in Long Beach.
Contentions
PLAINTIFF'S CONTENTIONS:
As part of it's operations, McDonnell used various toxic and poisonous chemicals and substances. One of McDonnell's former plants was located very close to the Long Beach College Campus. As a result of their use of these dangerous chemicals and pollutants, Gibson alleged that her mother contracted cancer that she eventually died from.
DEFENDANT'S CONTENTIONS:
McDonnell argued that Gibson failed to state facts sufficient to support her cause of action.
Result
The court granted a demurrer for the defense.
