Facts
On May 12, 2011, Maria Camacho was a pedestrian in a crosswalk on Howard Street at or near 8th Street in the City and County of San Francisco, when an accident involving John Castelli, an employee of the City and County, occurred. On March 7, 2012, Camacho sued Castelli, as well as the City and County.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff alleged that Castelli drove negligently, hitting plaintiff and injuring her as a result. Plaintiff also claimed that Castelli and the City and County were the legal cause of injuries and damages to plaintiff.
DEFENDANTS' CONTENTIONS:
The City did not contest liability in this case.
Injuries
Plaintiff claimed she suffered substantial injuries including a fracture that required transport to the hospital and extensive treatment.
Result
The parties settled for $50,000. Plaintiff only recovered $39,000; $11,000 was transferred to San Francisco General Hospital in satisfaction of a lien.
